Joseph G. Davis is a partner in the Litigation Department of Willkie Farr & Gallagher LLP in Washington, D.C. Mr. Davis specializes in complex litigation and corporate compliance matters.

Mr. Davis represents corporations and individuals in proceedings before federal and state courts and other tribunals. He has represented domestic and foreign clients in connection with securities and antitrust enforcement actions conducted by the United States Department of Justice, the United States Securities and Exchange Commission and other regulatory agencies. He has litigated civil securities actions, adversary proceedings in bankruptcies, insurance coverage actions, professional malpractice actions and various kinds of contract and business disputes. He advises telecommunications clients on laws related to wiretapping and the handling of wire and electronic communications.

Mr. Davis has conducted a number of corporate internal investigations. In particular, he was lead counsel in an internal investigation concerning allegations of adverse health effects connected with a multi-billion-dollar industry. Mr. Davis also has significant experience in toxic tort and environmental insurance litigation.

Selected Professional and Business Activities

Mr. Davis is a member of the American Bar Association. He has served on the Board of Directors of, and volunteers for, the Arlington Food Assistance Center, a not-for-profit organization that provides free groceries to low-income families in Arlington County, Virginia.

Selected Significant Matters

Antitrust Litigation:  counsel to major international electronic and photographic media manufacturer in California class action alleging conspiracy to exclude competitor and price fixing.

Bankruptcy Litigation:  counsel to major Japanese steel manufacturer in $150 million adversary proceeding and various contested matters.

Complex Litigation:  represented major satellite communications company in derivative action brought against the company, former President Clinton, Senator Clinton, Former Vice President Gore and others.

Complex Litigation:  counsel to significant foreign company in defense of $200 million ERISA claim.

Grand Jury Investigation:  defense of major retail company in multiple investigations regarding immigration and other alleged violations.

Government Investigation:  represented large audio-visual products company in connection with an investigation of accounting matters by the United States Securities and Exchange Commission.

Internal Investigation:  counsel to mutual funds manager in connection with trading practices.

Securities Litigation:  counsel to top former officers and directors of public company in federal securities action in New York and related state-court fraud action in Florida.

Toxic Tort Litigation:  represented one of the largest U.S. common carriers in toxic tort actions brought by thousands of plaintiffs in federal court in Louisiana. 

Wiretapping and Subpoena Compliance:  advise numerous providers of communication services concerning Title III, the Electronic Communications Privacy Act, the Patriot Act and other laws related to wiretapping and responses to government and other requests for information.

Pro Bono:  amicus briefing in the United States Supreme Court and the United States Court of Appeals on behalf of the Association of the Bar of the City of New York and others in the Jose Padilla (U.S. “enemy combatant”) case.

Pro Bono:  representation of convicted federal judge before the United States Supreme Court and the United States Court of Appeals for the Ninth Circuit, en bancSeeUnited States v. Aguilar, 515 U.S. 593 (1995).
